Terms of Service

SECTION 1: As an Internet service provider ("ISP"), MyWiFiNation offers its subscribers the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. This Acceptable Use Policy is intended to inform you of your rights and obligations. You will indicate your acceptance of these policies by maintaining an account with MyWiFiNation or by using the MyWiFiNation network, services or facilities. MyWiFiNation may supply one or more documents requesting a signature of acceptance for these policies. MyWiFiNation reserves the right to post changes and/or additions to this Acceptable Use Policy at any time without prior notice. MyWiFiNation reserves the right to cancel any account at any time, for any reason, including but not limited to violation of our Acceptable Use Policy. Persons wishing to sign up for a new account or service, must be 18 years of age or older. The parent or legal guardian of any underage person who is in violation of the MyWiFiNation Acceptable Use Policy using any MyWiFiNation account or who establishes an account with MyWiFiNation will be held responsible for any damage, penalties and/or account charges incurred.

SECTION 2: MyWiFiNation will not accept any responsibility or liability for intrusive, compromising, damaging, inaccurate, unsuitable or offensive Internet media and/or communications nor will it accept responsibility or liability for any damage and/or loss incurred as a result of such activities and/or events. Subscriber is responsible for damages of modem and will be required to purchase new equipment at current market value.

SECTION 3: MyWiFiNation is not liable for any information its subscribers may create, disseminate or otherwise transfer. Subscribers are wholly responsible for any and all information they may create, disseminate or otherwise transfer using the MyWiFiNation network, services or facilities and are encouraged to become familiar with all laws and regulations pertaining to copyright infringement, intellectual property, fraudulent or malicious acts as well as hateful, defamatory and other harmful forms of speech. Information disseminated or otherwise transferred through the use of the MyWiFiNation network, services or facilities may reach a large number of people, including both subscribers and non-subscribers of MyWiFiNation and may cause harm to MyWiFiNation's good name, reputation or operations. Subscribers are in violation of MyWiFiNation policy and the MyWiFiNation Acceptable Use Policy agreement when they, their affiliates or subsidiaries engage in any of the following activities: a. Distribution of Unsolicited Bulk Messages (Spamming) - Mass distribution of unsolicited messages using e-mail or other message posting technologies (commonly known as "spamming") is strongly disfavored among both Internet users and Internet service providers. The process of purging the MyWiFiNation network, services or facilities of SPAM caused by any MyWiFiNation subscriber is billable to the offending subscriber at the rate of $75.00 per hour, with a two-hour minimum. MyWiFiNation may, at its own discretion, terminate its services for anyone directly or indirectly participating in this activity without warning or notice. b. Copyright Infringement - Subscribers who infringe upon copyrights held by individuals, corporations or any other entity might also be held civilly and/or criminally liable for such acts. c. Storage, Distribution or Transfer of Obscene, Indecent or Hateful Material - Subscribers who store, distribute or transfer indecent, hateful or obscene material using the MyWiFiNation network, services or facilities may be found to be civilly and/or criminally liable for such acts. d. Illegal or Unauthorized Access to Other Computers, Devices, Networks, Services or Systems - Subscribers who illegally or otherwise access other computers, networks or systems without authorization (commonly known as "hacking") may be found to be civilly and/or criminally liable for such acts. e. Export Control Violations - Subscribers who illegally store, distribute, make available or otherwise transfer certain types of software or technology using the MyWiFiNation network, services or facilities and are in violation of United States Export Control laws may be found to be civilly and/or criminally liable for such acts. f. MyWiFiNation uses the most current anti-virus software available and we take every precaution to insure our incoming and outgoing mail is clean and virus free. Some computer viruses are uncleanable by any anti-virus program.  Consequently, an anti-virus program might make a workstation unusable if any infected critical files can not be cleaned properly.  At no time will MyWiFiNation be held liable for any corruption and/or loss of data in any form nor for any damages or loss in performance, including lost profits or savings, as a result of this service.

SECTION 4: All technical support provided by representatives of MyWiFiNation is provided without any warranty of any kind either expressed or implied and is accepted by the recipient of any such advice at the recipient's own risk. MyWiFiNation is not liable for any costs incurred by the user including, but not limited to, the cost of professional technical consultations, software or hardware repair services or any actual or potential loss or damage incurred as a result of the user's inability to access or use the MyWiFiNation subscription services or the loss of or inability to access any data or resources accessed via the MyWiFiNation subscription services.

SECTION 5: MyWiFiNation cannot take any responsibility for the security of communications transmitted using MyWiFiNation's networks, services or facilities. MyWiFiNation will comply fully, however, with all applicable laws concerning the privacy of its subscribers' on-line communications. MyWiFiNation will not intentionally disclose to any outside entity or third party, any private electronic mail messages sent or received by a subscriber or any personal information about the subscriber unless it is required to do so by law or to assist a debt collections agency of MyWiFiNation's choosing for the purpose of collecting a past due debt owed to MyWiFiNation by the subscriber.

SECTION 6: MyWiFiNation bills for services monthly. If you are under contract with MyWiFiNation for an extended period of time or for a prepaid period of service, MyWiFiNation will bill you in accordance with the timetable relevant to the contract period. MyWiFiNation does not issue refunds or credits for service periods consisting of less than a single month of service. Subscribers who have a legitimate claim to a credit or refund as defined by the MyWiFiNation Acceptable Use Policy must allow thirty calendar days for the processing of their credit or refund request. MyWiFiNation reserves the right to revoke or deny any claim for credit or refund upon review of the claim by MyWiFiNation even if a credit or refund has already been issued. Accounts for which payment in full has not been received within fifteen calendar days from the billing date will be considered to have become past due. If a subscriber's check payment is returned to MyWiFiNation due to insufficient funds or is marked "NSF" then MyWiFiNation will assess to the subscriber's account a returned check fee in the amount of twenty US dollars. MyWiFiNation designates a billing e-mail address as the address to which MyWiFiNation will attempt to deliver each billing statement generated for the subscriber's account. It is the responsibility of each subscriber to know the designated billing e-mail address for their account and to retrieve the MyWiFiNation billing statements in a timely manner from the e-mail account associated with the designated billing e-mail address for their account. MyWiFiNation may also issue printed, hard copy billing statements at an additional cost. Failure by any subscriber to notify a representative of the MyWiFiNation Customer Care department via live, interactive telephone communication of any changes to their contact information, including full name, postal mailing address, daytime telephone number or billing e-mail address, is a violation of the MyWiFiNation Acceptable Use Policy. MyWiFiNation may suspend the use of its networks, services or facilities for any account that has become past due and reserves the right to cancel any account which has become past due without prior notice or warning and reserves the right to deny future service to any subscriber who has a prior history of non-payment for MyWiFiNation products or services. If your account becomes past due MyWiFiNation reserves the right to refer any information obtained about the account holder, subscribers using the account or any other information it can obtain relating to the past due account to one or more third party debt collections services of its choosing. Negative information regarding the subscriber's credit worthiness may be placed in the subscriber's credit history files as a result of such referral.  If subscriber cancels service before the end of the agreement, Subscriber is required to pay remaining months of service multiplied by monthly recurring fee. Customer must call to cancel anti-virus and spam blocking software after free trial, or will be automatically billed monthly for the services.

SECTION 7: MyWiFiNation wishes to emphasize that in opening an account with MyWiFiNation, subscribers indemnify MyWiFiNation for any violation of this Acceptable Use Policy document, or of law or MyWiFiNation policy, that results in loss to MyWiFiNation or the bringing of any claim against MyWiFiNation. This means that if MyWiFiNation is sued because of activities of the subscriber that violate any law or the MyWiFiNation Acceptable Use Policy, the subscriber will pay any damages awarded against MyWiFiNation, plus costs and reasonable attorneys fees.
